RadarScreen Service Agreement



1. General condition


RADARME LLC, hereinafter referred to as “Provider”, provides the RadarScreen service. The RadarScreen service is subject to the following tariffs:

The RadarScreen service encompasses an extended warranty for a display module of a mobile device, as well as a guaranteed repair or replacement of the display module once within 12 (twelve) months from the date of the service activation.
This Agreement sets out rules for the provision of the RadarScreen service, as well as the rights and obligations of the parties.


2. Terms


The used in the Agreement are the following:

Questionnaire – a document containing information about the User and the User’s consent to the terms of the Agreement posted on the website of the service: www.radarscreen.com.ua.

Application for the service, hereinafter referred to as “Application” – an application form successfully submitted by the User, which is filled out by the User after diagnosing the display module of the smartphone using a mobile application.

Mobile app, or “App” – a free mobile application for smartphones, which is used to diagnose the display module of the User’s phone. The application is available for download in the following application stores: App Store, Google Play, or Huawei AppGallery. The smartphone on which the application is supposed to run must meet the following technical requirements of the operating system:

Android version 7.0.0 and above,

iOS version 10 and above.

Personal Cabinet – the Subscriber’s account containing the Application Form, information about the Subscriber’s connected mobile device, which is available in the App or on the website https://myscreen.theradar.com.ua/login/radarua_kb.

Tariffs – a set of services provided by the Provider and specified in the Agreement.

Insurer – an insurance company with which a contract has been signed about voluntary insurance of liability before third parties. The subject of the extended warranty or the object of protection is the display module of the User’s mobile device (smartphone) or iPhone.

Repair – elimination of damage to the display module of the device under the conditions specified in the Rules.

Agreement – an agreement about the provision of the RadarScreen service. This Agreement is a public contract in the sense of Article 633 of the Civil Code of Ukraine, and operates within the RadarScreen service. The text of the Agreement is posted on the website www.radarscreen.com.ua.

Rules for the provision of the RadarScreen service (hereinafter referred to as “Rules”) – a list of conditions and restrictions under which this service is provided. The Rules are an integral part of this Agreement, and are posted on the website www.radarscreen.com.ua.

Mobile Device Repair Service Center (hereinafter referred to as “SC”) – a facility repairing mobile devices, defined by the Provider; the list of SCs is posted on the website www.radarscreen.com.ua.

Display module – a part of a device that is used to display information and images (letters, numbers, or graphics) that can be integrated with the touch panel.

Damage – mechanical damage to the display module of the Device covered by the service, consisting of a breakdown or cracking, which necessitates repairing in order to restore the proper functioning of the device.

Discount – a reduction in the cost of subscribing to a Tariff provided by the Provider through a promo code, which the User can activate when choosing a subscription. The discount has a limited validity period, after which the User pays the full cost of the Subscription.


3. Conclusion of the Agreement and its validity period


  1. The Agreement is considered as concluded once the Provider has confirmed the Application Form submitted by the User. The application is submitted after the download and installation of the RadarScreen mobile app, successful diagnostics of the display module using the specified application, selection of a subscription directly in the app, as well as the in-app confirmation of the activation request.
    The services specified in Section 4 of this Agreement shall be provided by the Provider from the moment of concluding this Agreement, subject to activation by the User (activation means verification of the Application Form by the Provider and successful authorization of the Client’s bank card).
  2. This Agreement is valid from the date of commencement of the services specified in Section 4 of this Agreement until the moment of the User’s refusal to use the service through the disconnection function in the Personal Account.
  3. The Agreement is valid for 12 months. After the expiration, the Agreement is extended for a new term automatically, whereby a new agreement enters into force for a new term.
  4. The Agreement is terminated at the moment of disconnection of the Service.

4. Services provided by the provider under the Agreement


The Provider is obliged to provide the User with:

a subscription under the “Economy”, “Standard”, or “Premium” tariffs, which includes an extended warranty for the Subject of protection comprising of diagnostics and a one-time guaranteed repair or replacement of the display module of the User’s mobile phone within 12 months from the date of conclusion of this Agreement. The Service also provides for the delivery of a mobile phone to the Service Center and back to the User.


4.1. RadarScreen

  1. As part of the RadarScreen service, the Provider undertakes to provide the User with access to a mobile app for devices based on the Android/HMS and iOS operating systems, which the User must download independently from the app stores and install on his/her mobile device. After installing the app, the User must perform the diagnostics of the mobile device, fill in the Application Form, select the tariff and subscription, authorize a bank card for further payment of the subscription, and submit the Application Form. After receiving the submitted Application Form, the Provider verifies the User’s Application Form within 24 hours and confirms or rejects it. After successful verification, the service is activated.
  2. If the Subject of protection has been damaged after the activation of the service, the User is obliged to immediately notify the Provider in order to be eligible for guaranteed repair in accordance with the Rules of the RadarScreen service. To inform the Provider about the damage to the Subject of protection, the User needs to either call the Support Service or submit a request for repair in the app or in the Personal Account.
  3. In the event of damage to the device, the User is obliged to act in accordance with the Rules
  4. If the total cost of repair of the Subject of protection in the SC exceeds the amount specified in Paragraph 1 of Section 4.2 of this Agreement, the User decides on further repairs at his/her own discretion and pays the difference between the cost of repair and the amount of compensation from the Provider.
  5. In case the User fails to provide complete data required in the registration form during the activation of the service, or provides erroneous data, or does not inform the Provider about the change of these data, the Provider is not responsible for non-compliance or improper compliance with the Agreement.
  6. Compensation for repair or replacement of the Subject of prolonged warranty is provided to active users of the RadarScreen service.
  7. The User may expect to have his/her Subject of prolonged warranty repaired or replaced in case he/she additionally pays the difference between the cost of the service for 12 months specified in Section 7.1 of this Agreement, and the amount actually paid under the current Agreement. The User has the opportunity to pay the difference in cashless form in favor of the Provider through the app or the User’s Personal Account using the integrated system of electronic payment; the fee for the transfer of funds will be deducted from the User.

4.2. Repair compensation

  1. The maximum amount of compensation for repairs is:
    • For the “Econom” tariff – UAH 2,000.
    • For the “Standart” tariff – UAH 4,000.
    • For the “Premium” tariff – no restrictions regarding the cost of repairs covered.
  2. In case the SC has informed the Provider about the inability to repair the display module of the User’s smartphone, or in cases described in the Rules, the Provider agrees to provide the User with a promo code granting a 100% discount for connecting a new device to the RadarScreen service.

5. Data protection


  1. The User’s personal data will be used by the Provider only for the purpose of fulfilling this Agreement. The data are provided by the User voluntarily in order to enable the Provider to fulfill its obligations under this Agreement.
  2. The User gives consent to the processing of his/her personal data by the Provider, including their reception from the User and/or third parties in the manner and under the conditions specified in the Law of Ukraine “On Personal Data Protection” №2297-VI from June 1, 2010 (hereinafter referred to as “Law”). The User grants the Provider the right to process his/her personal data in any manner provided for by the Law and/or at the discretion of the Operator.
  3. The User agrees to the transfer of his/her personal data to third parties whose involvement is necessary for the implementation of the actions specified in the Agreement. The User’s personal data will be transferred by the Provider to third parties solely to the extent necessary for the fulfillment of obligations under this Agreement.
  4. The User agrees to the transfer of his/her personal data to third parties (courier/postal services, the Service Center and the Insurer) for assistance in diagnosing and repairing the damaged Object of protection or for actions aimed at fulfilling the obligations under this Agreement.
  5. The User agrees to the transfer of his/her personal data to the Provider for personal communications (marketing information, other types of newsletters, etc.).
  6. The Provider does not have access to the files stored on the User’s mobile device. The Provider is not liable to the User in case of loss or damage of files on the mobile device during diagnostics or repair in the Service Center.
  7. If this Agreement is concluded with the assistance of a legal entity with which the Provider has entered into an agency or other agreement, the User instructs this legal entity to provide the Provider with the information provided by the User in the Questionnaire.
  8. The User agrees to receive advertising information about the Provider’s services via the e-mail address specified in the Application Form.
  9. The User agrees to his/her telephone conversations with the Provider being recorded if the User addresses the Provider with a notice of damage to the Object of protection.

6. License Terms of Use of the Mobile App


  1. Download and installation of the Mobile App on a mobile device constitutes full and unconditional consent to all the terms of the Agreement.
  2. The Mobile App is intended for independent installation on the device by the User. Under this Agreement:
    • Each registered sample of the Mobile App is intended for one registered Device.
    • When activating the Mobile App, the User is granted a non-exclusive and non-transferable license to install and use one (1) copy of the specified version of the Mobile App on one phone. The license is valid only for one mobile device on which the Mobile App has been installed and registered.
  3. The Provider grants the User the exclusive right (simple license) to use the Mobile App in the following ways:
    • Reproduction of the Mobile App, i.e., its recording in the memory of the mobile device for further operation exclusively within the framework of this Agreement.
    • Use of the Mobile App on the User’s device, including as part of the User’s software and hardware complex; installation on the User’s device.
    • The license fee is included in the cost of the selected subscription in accordance with Section 7 of the Agreement.
  4. The Mobile App should be used under the name ‘RadarScreen.’ The User has no right to change the name of the Mobile App, change and/or delete the copyright mark or other information identifying the Copyright Holder, i.e., the Provider.
  5. Trademarks, service marks, images and logos used with the Mobile App are registered trademarks. The User does not receive any rights or licenses for any of the aforementioned trademarks, and undertakes to refrain from removing, concealing or altering any proprietary marks (including trademark and copyright notices) that may be added to or contained in the Mobile App.

7. Payment for the RadarScreen service


  1. The User pays the cost of the RadarScreen service in accordance with the selected subscription to the Tariff. Payment is made using the integrated Internet acquiring system in the App or through the Personal account (Tariffs include all taxes):
    • The monthly fee for subscribing to the Economy Tariff is UAH 39, while the 12-month-fee is UAH 468;
    • The monthly fee for subscribing to the Standard Tariff is UAH 59, while the 12-month-fee is UAH 708;
    • The monthly fee for subscribing to the Premium Tariff is UAH 149, while the 12-month-fee is UAH 1788.
  2. In case of the User’s failure to pay for the RadarScreen service, the Provider is not required to provide services under this Agreement.
  3. If the funds on the User’s account are insufficient to pay for the subscription at the time of connection of the Service, attempts to charge the Subscriber shall continue for 60 calendar days. In case of insufficient funds on the Subscriber’s account during the specified period, it will be considered that the Subscriber has canceled the Subscription.
  4. Upon expiration of the Subscription term, if the funds on the Subscriber’s account are insufficient for its prolongation, the possibility of automatic renewal of the Subscription is retained for 60 calendar days after the expiration of the previous Subscription. In case of insufficient funds on the Subscriber’s account during the specified period, it will be considered that the Subscriber has canceled the Subscription.

8. Responsibilities of the parties


  1. When using the RadarScreen service, the User is obliged to immediately inform the Provider about the damage to Object of protection using phone numbers of the 24-hour Customer Support Team as mentioned on the website.
  2. Informing the Provider about the damage to the Object of protection is the basis for the actions specified in Sections 4.1 and 4.2 of this Agreement.
  3. In case of non-fulfillment or improper fulfillment of the terms of this Agreement, the Parties shall be held liable in accordance with the current legislation of Ukraine.
  4. The Parties shall be released from liability for partial or complete non-fulfilment of obligations under this Agreement if such non-fulfilment has been caused by force majeure, i.e., the circumstances that have occurred against the will of the Parties and could not be prevented through timely and reasonable measures. Under the circumstances of force majeure, the Parties shall understand: war, hostilities, natural disasters, explosions, strikes, acts of the authorities affecting the performance of the obligations, as well as other events and circumstances that will be recognized as force majeure during legal proceedings.

9. Settlement of Disputes


  1. The Parties agree that all disputes arising in the course of the implementation of this Agreement shall be settled through negotiations between the Parties on the basis of goodwill and mutual understanding.
  2. In case the User has any claims towards the Provider, the User submits the corresponding statement with a clear description of his/her claim. The Provider is obliged to respond to the User within 30 calendar days from the date of receipt of the User’s claim.
  3. In case it is impossibility to resolve disputes through negotiations, disputes between the Parties shall be resolved in court according to the current legislation of Ukraine.

10. Miscellaneous


  1. The Provider has the right to make changes to the terms of this Agreement. The Provider shall notify the User about the changes by publishing them on the website www.radarscreen.com.ua.
  2. If the User continues to use the RadarScreen service after the terms of this Agreement have been changed, the User is considered to have confirmed his agreement with these changes.
  3. Everything that is not accounted for by this Agreement is regulated by the current legislation of Ukraine.
